En el presente artículo proponemos una reflexión sobre el concepto y los usos de la interculturalidad en América Latina. Pensamos que debemos seguir apostando por la posibilidad de construcciones discursivas alternativas, críticas y estéticas observables y vivenciales en el derecho a la educación, respetando y aprendiendo de las diferencias. Partimos de una epistemología «otra» que pone en discusión el conocimiento «universal», en la medida que buscamos posicionar conocimientos «otros». Asimismo, cuestionamos lo establecido por la institucionalidad de los discursos oficiales y (...) apelamos a iniciativas emergentes enfocadas en la construcción y consolidación de nuevas subjetividades. En el marco de una relacionalidad vivencial simbólica buscamos dar cuenta de la unidad en la diversidad, la dualidad complementaria y la reciprocidad, lo que implica que sigamos apuntándola a un intercambio dinámico y fluido de saberes, y a la construcción colectiva del conocimiento como responsabilidad social compartida, no sólo en el discurso, sino en actos coherentes de una diversidad de actores sociales que aprecian sus diferencias, pero no son ajenos a la situación de los otros y a la inequidad social. In this paper we intend to reflect on the concept and practices of multiculturalism in Latin America. We think we should keep committing ourselves to the possible creation of alternative, critical, aesthetic, experiential and perceptible discourses on the right to be educated, respecting and learning from differences. We start from an «other» epistemology that raises questions about the «universal» knowledge as we seek to locate «other» knowledges. Furthermore, we question what is established by the institutionalization of official speeches, and we appeal to emerging initiatives focused on the construction and consolidation of new subjectivities. As part of a symbolic experiential relatedness we aim to account for unity in diversity, complementary duality and reciprocity, which means that we continue pointing out to a dynamic and fluid knowledge exchange, and to the collective construction of knowledge as a shared social responsibility not only in speech, but also in consistent acts of a variety of social actors who appreciate their differences, not unaware of the situation of other people and of social inequality. Michael Ruse’s new anthology Philosophy After Darwin provides great history and background in the major impacts Darwinism has had on philosophy, especially in ethics and epistemology. This review focuses on epistemology understood through the lens of evolution by natural selection. I focus on one of Ruse’s own articles in the collection, which responds to two classic articles by Konrad Lorenz and David Hull on the two major forms of evolutionary epistemology. I side with Ruse against Lorenz’s account of the (...) necessity we think our principles of reasoning have, though I disagree with Ruse’s particular example. I also argue that Ruse’s alternative explanation is lacking. Against Hull, I side with Ruse in his doubts that a sociobiological approach to science will prove fruitful, though I point out that it has certain advantages other approaches do not have. Although I side with Ruse on the issue, I conclude that the two views do not really come into direct conflict and so one needs not reject either. Finally, I discuss Ruse’s positive view and raise questions for his conception of evolutionary epistemology. I conclude that his arguments are insufficient to overcome opposing views and his view has at least as many unintuitive conclusions as the alternatives. (shrink)

To date, no definition of life has been unequivocally accepted by the scientific community. In frustration, some authors advocate alternatives to standard definitions. These include using a list of characteristic features, focusing on life’s effects, or categorizing biospheres rather than life itself; treating life as a fuzzy category, a process or a cluster of contingent properties; or advocating a ‘wait-and-see’ approach until other examples of life are created or discovered. But these skeptical, operational, and pluralistic approaches have intensified the debate, (...) rather than settled it. Given the failure of even these approaches, we advocate a new strategy. In this paper, we reverse the usual line of reasoning and argue that the “life problem” arises from thinking incorrectly about the nature of life. Scientists most often conceptualize life as a class or kind, with earthly life as a single instance of it. Instead, we advocate thinking about Earth’s Life as an individual, in the way that species are now thought to be. In this view, Life is a monophyletic clade that originated with a last universal common ancestor, and includes all its descendants. We can continue to use the category ‘life’ pragmatically to refer to similarities between various phenomena and Life. But the relevant similarities are a matter of interest and preference, not a matter of fact. The search for other life in the Universe, then, is merely a search for entities that resemble parts of Life in whatever sense astrobiologists find most appealing. This does not mean that the search for evolved complexity elsewhere in the universe or its creation in the lab are futile endeavors, but that debates over whether they count as ‘life’ are. Ironically, finally abandoning the concept ‘life’ may make our searches for evolved complexity more fruitful. We explain why. (shrink)

The "people of knowledge" of traditional Mazatec medicine have preserved until today the ritual use of psilocybin mushrooms as part of their health care systems. The renewed interest in the effect of psilocybin on human consciousness for both therapeutic and recreational purposes usually obviates the historical and cultural background of indigenous peoples, as well as the legitimation of their practices and knowledge. In this article, through the case study of a foreign person who attended a Mazatec ritual specialist to participate (...) in a ritual night ceremony known as velada, we show the importance of approaching research on psychoactive plants and mushrooms from a transdisciplinary and intercultural perspective, so that we can appreciate the profound complexity of the healing processes that take place in traditional indigenous contexts, as well as the limits of recreational uses or exclusively neopositivist and clinical approaches. The CRISPR system for gene editing can break, repair, and replace targeted sections of DNA. Although CRISPR gene editing has important therapeutic potential, it raises several ethical concerns. Some bioethicists worry CRISPR is a prelude to a dystopian future, while others maintain it should not be feared because it is analogous to past biotechnologies. In the scientific literature, CRISPR is often discussed as a revolutionary technology. In this paper we unpack the framing of CRISPR as a revolutionary technology and contrast (...) it with framing it as a value-threatening biotechnology or business-as-usual. By drawing on a comparison between CRISPR and the Ford Model T, we argue CRISPR is revolutionary as a product, process, and as a force for social change. This characterization of CRISPR offers important conceptual clarity to the existing debates surrounding CRISPR. In particular, conceptualizing CRISPR as a revolutionary technology structures regulatory goals with respect to this new technology. Revolutionary technologies have characteristic patterns of implementation, entrenchment, and social impact. As such, early identification of technologies as revolutionary may help construct more nuanced and effective ethical frameworks for public policy. (shrink)

In this commentary to Leal (2013), we argue that the memorization of the names and symbols of the chemical elements is necessary in the study of that topic because this task is the key for the later understanding of the Periodic Table. We can make the memorization task in an enjoyable, but effective way, using some educational games in chemistry class. Some recent puzzles, card games, mnemonics rules or games based on drawings to learn the chemical elements are addressed in (...) this paper. (shrink)

En el curso dictado en Collège de France sobre la institución y la pasividad, Merleau-Ponty le otorgó una importancia particular a las problemáticas freudianas. La sexualidad y muy especialmente el Complejo de Edipo, es presentado como ejemplo de la institución humana en un doble sentido: en cuanto clase de institución que se diferencia de la institución vital y como una institución antropomórfica. Sus momentos –sexualidad prepuberal, periodo de latencia, pubertad– ejemplifican la estructura de toda institución: la anticipación, el desvío y (...) la reanudación y ponen de manifiesto su temporalidad propia. En vistas a la importancia del Complejo de Edipo en la arquitectura general del curso, el presente trabajo tiene por objetivo reponer la interpretación realizada por Merleau-Ponty a los efectos de comprender la especificidad de la institución humana. De este modo, se pretende realizar una aproximación al vínculo entre temporalidad e institución tal como Merleau-Ponty lo considera en el curso en cuestión.In the course dictated in Collège de France on the institution and the passiveness, Merleau-Ponty granted a particular importance to the Freudian problematics. The sexuality and very specially the Complex of Oedipus, is presented as example of the human institution in a double meaning: regarding a type of institution that differs from the vital institution and as an anthropomorphic institution. Its moments – prepuberal sexuality, period of latency, puberty –exemplify the structure of any institution: the anticipation, the detour and the resumption and they reveal his own temporality. In conference to the importance of the Complex of Oedipus in the general architecture of the course, the present work has for aim re-put the interpretation realized by Merleau-Ponty to the effects of understanding the specificity of the human institution. Thus, one tries to realize an approximation to the link between temporality and institution as Merleau-Ponty considers it in the course in question. (shrink)

Is it possible to know anything about life we have not yet encountered? We know of only one example of life: our own. Given this, many scientists are inclined to doubt that any principles of Earth’s biology will generalize to other worlds in which life might exist. Let’s call this the “N = 1 problem.” By comparison, we expect the principles of geometry, mechanics, and chemistry would generalize. Interestingly, each of these has predictable consequences when applied to biology. The surface-to-volume (...) property of geometry, for example, limits the size of unassisted cells in a given medium. This effect is real, precise, universal, and predictive. Furthermore, there are basic problems all life must solve if it is to persist, such as resistance to radiation, faithful inheritance, and energy regulation. If these universal problems have a limited set of possible solutions, some common outcomes must consistently emerge. In this chapter, I discuss the N = 1 problem, its implications, and my response (Mariscal 2014). I hold that our current knowledge of biology can justify believing certain generalizations as holding for life anywhere. Life on Earth may be our only example of life, but this is only a reason to be cautious in our approach to life in the universe, not a reason to give up altogether. In my account, a candidate biological generalization is assessed by the assumptions it makes. A claim is accepted only if its justification includes principles of evolution, but no contingent facts of life on Earth. (shrink)

In this review, we describe some of the central philosophical issues facing origins-of-life research and provide a targeted history of the developments that have led to the multidisciplinary field of origins-of-life studies. We outline these issues and developments to guide researchers and students from all fields. With respect to philosophy, we provide brief summaries of debates with respect to (1) definitions (or theories) of life, what life is and how research should be conducted in the absence of an accepted theory (...) of life, (2) the distinctions between synthetic, historical, and universal projects in origins-of-life studies, issues with strategies for inferring the origins of life, such as (3) the nature of the first living entities (the “bottom up” approach) and (4) how to infer the nature of the last universal common ancestor (the “top down” approach), and (5) the status of origins of life as a science. Each of these debates influences the others. Although there are clusters of researchers that agree on some answers to these issues, each of these debates is still open. With respect to history, we outline several independent paths that have led to some of the approaches now prevalent in origins-of-life studies. These include one path from early views of life through the scientific revolutions brought about by Linnaeus (von Linn.), Wöhler, Miller, and others. In this approach, new theories, tools, and evidence guide new thoughts about the nature of life and its origin.We also describe another family of paths motivated by a” circularity” approach to life, which is guided by such thinkers as Maturana & Varela, Gánti, Rosen, and others. These views echo ideas developed by Kant and Aristotle, though they do so using modern science in ways that produce exciting avenues of investigation. By exploring the history of these ideas, we can see how many of the issues that currently interest us have been guided by the contexts in which the ideas were developed. The disciplinary backgrounds of each of these scholars has influenced the questions they sought to answer, the experiments they envisioned, and the kinds of data they collected. We conclude by encouraging scientists and scholars in the humanities and social sciences to explore ways in which they can interact to provide a deeper understanding of the conceptual assumptions, structure, and history of origins-of-life research. This may be useful to help frame future research agendas and bring awareness to the multifaceted issues facing this challenging scientific question. (shrink)

This chapter will be a brief survey of the concepts from general philosophy of science for those interested in cognitive science. It covers several major topics in the philosophy of science: scientific explanation and underdetermination, reductionism and levels of nature, and scientific realism. We will discuss the goals of science, the methods of science, and the most plausible interpretations of science. To demonstrate the importance of these topics, the chapter includes cases in which confusion over these issues has led scientists (...) astray. These cases include instances in which cognitive neuroscience has failed to discover adequate explanations for phenomena, when previously established research did not withstand further scrutiny, and the increasingly complex and bewildering interrelationship between the study of the mind and the study of the brain and its parts. These issues are common to many areas of science, but they can be particularly fraught in a field like cognitive neuroscience, as researchers from a wide variety of disciplinary backgrounds and research foci come together to develop a systematic understanding of the mind. Background: Eye movement desensitization and reprocessing [EMDR] is an innovative, evidence-based and effective psychotherapy for post-traumatic stress disorder [PTSD]. As with other psychotherapies, the effectiveness of EMDR contrasts with a limited knowledge of its underlying mechanism of action. In its relatively short life as a therapeutic option, EMDR has not been without controversy, in particular regarding the role of the bilateral stimulation as an active component of the therapy. The high prevalence of EMDR in clinical practice and the dramatic increase (...) in EMDR research in recent years, with more than 26 randomized controlled trials published to date, highlight the need for a better understanding of its mechanism of action. Methods: We conducted a thorough systematic search of studies published until October 2017, using PubMed, ScienceDirect, Web of Knowledge and Scopus databases that examined the mechanism of action of EMDR or provided conclusions within the framework of current theoretical models of EMDR functioning. Results: Seventy-five studies were selected for review and classified into three overarching models; (i) psychological models (ii) psychophysiological models and (iii) neurobiological models. The evidence available from each study was analysed and discussed. Results demonstrated a reasonable empirical support for the working memory hypothesis and for the physiological changes associated with successful EMDR therapy. Recently, more sophisticated structural and functional neuroimaging studies using high resolution structural and temporal techniques are starting to provide preliminary evidence into the neuronal correlates before, during and after EMDR therapy. Discussion: Despite the increasing number of studies that published in recent years, the research into the mechanisms underlying EDMR therapy are still in its infancy. Studies in well-defined clinical and non-clinical populations, larger sample sizes and tighter methodological control are further needed in order to establish firm conclusions. (shrink)

Our understanding of the universe has grown rapidly in recent decades. We’ve discovered evidence of water in nearby planets, discovered planets outside our solar system, mapped the genomes of thousands of organisms, and probed the very origins and limits of life. The scientific perspective of life-as-it-could-be has expanded in part by research in astrobiology, synthetic biology, and artificial life. In the face of such scientific developments, we argue there is an ever-growing need for universal biology, life-as-it-must-be, the multidisciplinary study of (...) non-contingent aspects of life as guided by biological theory and constrained by the universe. We present three distinct but connected ways of universalizing biology—with respect to characterizing aspects of life everywhere, with respect to the explanatory scope of biological theory, and with respect to extending biological insights to the structure of nonbiological entities. For each of these, we sketch the theoretical goals and challenges, as well as give examples of current research that might be labeled universal biology. (shrink)

In the 1970s, R.D. MacElroy coined the term ‘extremophile’ to describe microorganisms that thrive under extreme conditions (MacElroy 1974). This hybrid word transliterates to ‘love of extremes’ and has been studied as a straightforward concept for the past 40 years. In this paper, we discuss several ways the term has been understood in the scientific literature, each of which has different consequences for the distribution and importance of extremophiles. They are, briefly, Human-Centric, at the Edge of life’s habitation of Morphospace, (...) by appeal to Statistical Rarity, described by Objective Limits, and at the Limits of Impossibility for metabolic processes. Importantly, these concepts have co-existed, unacknowledged and conflated, for decades. Confusion and equivocation threaten to follow from the wildly varied inclusion or exclusion of organisms as extremophiles depending on the concept used. Under some conceptions, entire kinds of extremophiles become meaningless. Since our understanding of how life works is shaped by what we take to be its extremes, clarifying extremophily is key for many large-scale projects in biology, ecology, biotechnology and astrobiology. In what follows, we proceed as if a noncontroversial account of life is possible and that it is possible to find complex chemistry in the Universe that is similar enough to Life on Earth such that both may be considered instances of ‘life’ (but see Mariscal & Doolittle 2018). We raise, but do not address, the questions of whether the distribution of Life on Earth is representative of what we may find elsewhere in the Universe, whether the same kinds of extremophiles would exist given a replay of the tape of life. Additionally, each of these concepts assumes life based on some sort of biochemistry in this universe, effectively setting aside claims made by some artificial life proponents that their digital organisms are genuine examples of life (Langton 1989, Ray 1995). On the distinction between extremophilic and extremotolerant, we note that all accounts accept the latter as a broader category than the former, since ‘phily’ means love and tolerance is a prerequisite for love under any conception. Indeed, there will be many extremely impoverished environments where tolerance is the only option and thriving is precluded, e.g. Bacillus marismortui was extracted and grown from 250-million-year-old salt crystals in the Permian Salado Formation in an inactive yet persistent state (Vreeland et al., 2000). We also note that extremophily, as a functional category, is potentially applicable at many levels of the biological hierarchy. Extremophily at one level does not necessarily extend to higher and lower levels. For instance, a microorganism in isolation might be quite intolerant to certain environmental conditions yet flourish when subjected to the same conditions as a community or natural biofilm. Alternatively, a protein molecule might be quite stable or active under certain conditions even if the optimal environment for the organism containing it is far more mesophilic. There is an industry of artificially selecting organisms and proteins to adapt to extreme environments (see van den Burg & Eijsink 2002), providing some justification to consider ‘functioning at extremes’ as a worthwhile category of investigation. Finally, we also note certain physico-chemical ranges are rarely considered with respect to extremophily – timespan, size, nutrient availability (Hoehler & Jørgensen 2013), etc. – as well as some biological parameters – abundance, isolation, competition, etc. Perhaps scientific interest must also come into play as to the reason these criteria are not considered relevant. We return to this issue later. In the next section, we give five definitions of extremophily, show their benefits, drawbacks, and unintended yet unavoidable consequences. These arguments are summarized in Table 1 and represented visually in Figures 1 and 2. Given research on polyextremophiles, it seems Figure 2 is a more plausible representation of the state of current knowledge than Figure 1 (Harrison et al. 2013). Life is patchily distributed across various dimensions, which may reflect its contingent history, poor sampling, or (perhaps) fundamental limits. Figure 3 shows the conceptual flowchart for all of these views. In the following section, we take a step back to ask whether we should choose between these definitions and how such a judgment could be made. We argue for a limited pluralism, in which some, but not all, of the concepts are acceptable relative to certain practical and theoretical aims. (shrink)

El presente trabajo elucida el axioma de “la pluralidad necesaria” a partir de algunas calas y notas del pensamiento de Judith Butler y algunos cruces procedentes de la filosofía de Michel Foucault y Friedrich Nietzsche, así como el influjo postnietzscheano contemporáneo, en contraste con el pensamiento mestizo subalterno latinoamericano de Gloria Anzaldúa. La hipótesis central es explicada en estos términos: no existe ningún fundamento metafísico que sustente al mundo; todo es una construcción cultural, resultado del poder predominante en un determinado (...) contexto histórico. El poder es el que establece lo que es normal o anormal, lo que está permitido o no está permitido. En este contexto, se postula la necesidad de someter a los dispositivos de poder reinantes, en las sociedades contemporáneas, bajo una revisión crítica que permita transformarlos en dispositivos de poder que hagan posible sociedades plurales e incluyentes. Y justo aquí, en la apertura de un nuevo horizonte postmetafísico y post-humanista es retomada la perspectiva mestiza subalterna de Gloria Anzaldúa como una forma radical de repensar la condición humana más allá del euro-logo-falocentrismo desde los márgenes de América Latina. La pluralidad necesaria, lejos de ser un título contradictorio, es, antes bien, un título que expresa una afirmación, a saber, la necesidad de una realidad social plural, inclusiva, en la que las diferencias entre los seres humanos sean respetadas, siguiendo el ideal de una sociedad democrática en la que se cultive la apertura a los otros, en un ambiente de convivencia y diálogo. Stephen Jay Gould argued that replaying the ‘tape of life’ would result in radically different evolutionary outcomes. Recently, biologists and philosophers of science have paid increasing attention to the theoretical importance of convergent evolution—the independent origination of similar biological forms and functions—which many interpret as evidence against Gould’s thesis. In this paper, we examine the evidentiary relevance of convergent evolution for the radical contingency debate. We show that under the right conditions, episodes of convergent evolution can constitute valid natural experiments (...) that support inferences regarding the deep counterfactual stability of macroevolutionary outcomes. However, we argue that proponents of convergence have problematically lumped causally heterogeneous phenomena into a single evidentiary basket, in effect treating all convergent events as if they are of equivalent theoretical import. As a result, the ‘critique from convergent evolution’ fails to engage with key claims of the radical contingency thesis. To remedy this, we develop ways to break down the heterogeneous set of convergent events based on the nature of the generalizations they support. Adopting this more nuanced approach to convergent evolution allows us to differentiate iterated evolutionary outcomes that are probably common among alternative evolutionary histories and subject to law-like generalizations, from those that do little to undermine and may even support, the Gouldian view of life. This book focuses on the emerging scientific discipline of astrobiology, exploring the humanistic issues of this multidisciplinary field. To be sure, there are myriad scientific questions that astrobiologists have only begun to address. However, this is not a purely scientific enterprise. More research on the broader social and conceptual aspects of astrobiology is needed. Just what are our ethical obligations toward different sorts of alien life? Should we attempt to communicate with life beyond our planet? What is “life” in the (...) most general sense? The current volume addresses these questions by looking at different perspectives from philosophers, historians, theologians, social scientists, and legal scholars. It sets a benchmark for future work in astrobiology, giving readers the groundwork from which to base the continuous scholarship coming from this ever-growing scientific field. (shrink)

In the half century since the formulation of the prokaryote : eukaryote dichotomy, many authors have proposed that the former evolved from something resembling the latter, in defiance of common (and possibly common sense) views. In such ‘eukaryotes first’ (EF) scenarios, the last universal common ancestor is imagined to have possessed significantly many of the complex characteristics of contemporary eukaryotes, as relics of an earlier ‘progenotic’ period or RNAworld. Bacteria and Archaea thus must have lost these complex features secondarily, through (...) ‘streamlining’. If the canonical three-domain tree in which Archaea and Eukarya are sisters is accepted, EF entails that Bacteria and Archaea are convergently prokaryotic.We ask what this means and how it might be tested. Se realizó una revisión documental con el objetivo de reseñar los aspectos históricos relacionados con el surgimiento y desarrollo de la Oftalmología en Camagüey. Se utilizaron documentos de la Biblioteca Provincial “Julio Antonio Mella” y la “Casa Finlay”; así como informaciones obtenidas en entrevistas personales. Se señalaron las características fundamentales de las formas, medios y técnicas de la atención médico-quirúrgicas en cada etapa, y se destacaron las personalidades científicas y los aportes realizados a la especialidad en la docencia, asistencia e (...) investigación. A documental revision was carried out with the objective of describing the historical aspects related with the origin and development of Ophthalmology in Camagüey. Documents from the “Julio Antonio Mella” Provincial Library and the “Finlay House” were used, as well as information obtained by personal interviews. The fundamental characteristics of the forms, means and techniques of the medical-surgical care in each period were pointed out, and were remarked the scientific personalities and the contribution made to the specialty in teaching, assistance and research. This article is about specific uses of the thought of Spinoza, studied through a selection of books concerning personal development and philosophy of management. Through a discourse of truth and authority, these texts give rise to the formulation of a Spinozism that philosophically justifies the ideal types of neoliberalism and make Spinoza the father of this social, political, and economic model. Thus, the authors want to convince individuals that they must concentrate on their affects, by postulating that happiness and freedom (...) can only be achieved by working on oneself. However, this means minimising the influence of a social exteriority that remains crucial to Spinozian philosophy. This article studies what has been retained from the Spinozian corpus, to make it correspond to neoliberalism and to apply these practices of personal development and philosophy of management. We also point out the limits of this singular interpretation of Spinoza, while questioning the relevance of this type of adaptation of his philosophy to contemporary times. (shrink)

Este artículo presenta una investigación cualitativa sobre los conceptos de Hermenéutica e ironía desde la revisión del texto rortiano Contingencia, ironía y solidaridad. A través de un recorrido por la Historia de la razón filosófica se muestra cómo el compromiso hermenéutico con el mundo está atravesado por las ideas de solidaridad y contingencia. Finalmente, se propone una lectura del círculo hermenéutico como reivindicación de una sociedad preocupada por la justicia que reconoce la carencia de todo amparo metafísico.

Esta investigación es un estudio sobre las relaciones entre las Redes Sociales y la trasformación del lenguaje. Se parte de la hipótesis de que la sociedad posmoderna es una red relacional directamente modificada por el fenómeno digital. Así, la vida en la red genera un metalenguaje en cuya virtud se origina el “mundo real”. A través de un examen de la literatura científica y una aproximación teórica basada en encuestas realizadas a jóvenes usuarios de Redes Sociales, se presenta un análisis (...) hermenéutico de elementos clave de nuestro tiempo y tan controvertidos como el uso de la ironía o la posverdad. El poema "De una carta de Macrobio Teodosio" de Luis Antonio de Villena se comprende más profundamente si se estudia como heredero del "Papyrus" de Ezra Pound por mostrar cómo la composición de textos fragmentarios permite crear poemas modernos de una inesperada capacidad evocadora. Asimismo, en la composición de Villena se encuentra la posible influencia de algunos imaginarios de la decadencia (Edward Gibbon, Constantinos Cavafis). Todo ello permitirá comprender las tres referencias a Virgilio, dos citas y una mención, que aparecen (...) en el poema. A propósito de la última, se propone una interpretación que actualiza el significado del mensaje final de Eneas a Palinuro en la Eneida. (shrink)

El presente trabajo elucida el axioma de “la pluralidad necesaria” a partir de algunas calas y notas del pensamiento de Judith Butler y algunos cruces procedentes de la filosofía de Michel Foucault y Friedrich Nietzsche, así como el influjo postnietzscheano contemporáneo, en contraste con el pensamiento mestizo subalterno latinoamericano de Gloria Anzaldúa. La hipótesis central es explicada en estos términos: no existe ningún fundamento metafísico que sustente al mundo; todo es una construcción cultural, resultado del poder predominante en un determinado (...) contexto histórico. El poder es el que establece lo que es normal o anormal, lo que está permitido o no está permitido. En este contexto, se postula la necesidad de someter a los dispositivos de poder reinantes, en las sociedades contemporáneas, bajo una revisión crítica que permita transformarlos en dispositivos de poder que hagan posible sociedades plurales e incluyentes. Y justo aquí, en la apertura de un nuevo horizonte postmetafísico y post-humanista es retomada la perspectiva mestiza subalterna de Gloria Anzaldúa como una forma radical de repensar la condición humana más allá del euro-logo-falocéntrismo desde los márgenes de América Latina. La pluralidad necesaria, lejos de ser un título contradictorio, es, antes bien, un título que expresa una afirmación, a saber, la necesidad de una realidad social plural, inclusiva, en la que las diferencias entre los seres humanos sean respetadas, siguiendo el ideal de una sociedad democrática en la que se cultive la apertura a los otros, en un ambiente de convivencia y diálogo. O presente trabalho trata da relevância da justiça para a crítica/justificativa do Direito, enquanto forma de estruturar as instituições sociais. Tendo Uma Teoria da Justiça como foco, a questão central neste ensaio é: como Rawls mobiliza os conceitos jurídicos? O objetivo geral é dialogar com os elementos centrais da obra de Rawls buscando compreender qual o papel do Direito no argumento em defesa da justiça como equidade. Para tanto, primeiro, retoma-se sucintamente os objetivos gerais pretendidos por Rawls com a teoria (...) elaborada. Em seguida, articula-se o uso de conceitos jurídicos com os objetivos pretendidos pelo autor em cada uma das três partes, para, então, enfatizar a serventia da justiça como equidade e da teoria política normativa aos juristas. Percorridos esses passos, defende-se a seguinte hipótese: o Direito é um elemento central na Teoria da Justiça de Rawls. Como desdobramento da hipótese, defende-se que para sustentar seu argumento central e desenvolver os principais elementos conceituais de sua obra, Rawls precisou recorrer aos conceitos jurídicos. Informed consent forms have been useful in clinical practice and they constitute a part of the shared decision making in the informed consent process. They provide information to patients about clinical procedures and techniques. They also act as a remainder of the information discussed after the medical interview. Sometimes these documents are not readable to everybody. Belgian law specifies that all information that patients receive has to be proportionate verbally, but written information is also handled. The present research analyzes the (...) readability of the Flemish informed consent forms located in the webs of all General Hospitals using a simple random sample of 75 informed consent forms. By using the Douma tool, which bases its analysis in the length of words and sentences, the readability mean of the sample was 46, level “Difficult”. The 59% of them had a difficult level. The 11% were normal. It is a fact, then, that the 59% of the informed consent forms evaluated in this study are not suitable for everybody in Flanders, especially those people with low literacy. There were some researches made in other countries that agreed with these results. Written clinical information was poorly written so the informed consent forms were not working helping patients to recall information nor helping patients to become a part in the shared decision making about their health. The use of readability formulas represented a simple way to discriminate those informed consent forms that had normal readability scores from those that should be adapted. (shrink)
